Can I retroactively file for my employees since I am just finding out about this tax credit?
At CMS, as Work Opportunity Tax Credit (WOTC) experts and service providers since 1997, we receive a lot of questions via our website. In the case of the above question, the sender did not provide their email address, so we were unable to reply directly to them. This is one of the more common questions (FAQ), so we thought we would share, and hopefully will help others too.
CMS Says: This is an extremely common question for us. Despite the massive amount of tax credits available to employers, not enough people in accounting or Human Resources know about this valuable tax credit. Unfortunately in your situation, we are unable to retroactively look back at new hires for any period. In order to capture potential tax credits, the 28-day rule applies, so we have to file the WOTC paperwork within 28 days of the employee’s start date. Although we cannot look back for you, you can implement the work opportunity tax credit immediately and capture potential credits going forward.
