Are there locations in the US that employers would not qualify to receive the “incarcerated” credit?
At CMS, as Work Opportunity Tax Credit (WOTC) experts and service providers since 1997, we receive a lot of questions via our website. In the case of the above question, the sender did not provide their email address, so we were unable to reply directly to them. This is one of the more common questions (FAQ), so we thought we would share, and hopefully will help others too.
CMS Says: The Work Opportunity Tax Credit is available in all 50 States. There are not any locations in the United States where you would “not qualify to receive the credit.”
A new hire meets the criteria for the Ex-Felon target group, if the individual:
- Has been convicted of a felony; AND
- Has a hiring date that is not more than 1 year after the conviction or release from prison.
