If we did not file the WOTC form within 28 days, does that mean we can’t apply at all?
CMS Says: Correct. If you did not file your WOTC “paperwork” within 28 days of the employee’s start date you have lost your opportunity to claim the Work Opportunity Tax Credit for that person. To avoid this in the future, try to file weekly, or bi-monthly if using paper. If you are using our call center or online portal, you can view the Dashboard to make sure employees are being compliant.
