Are 1099 Employees Eligible to Participate in WOTC program?
CMS Says: Employees who receive a 1099-MISC form are considered to be Independent Contractors, not employees. Since you are not paying taxes on their wages, they are not eligible under the WOTC program and you cannot obtain a tax credit when you hire them.
